Personal Data Protection Policy

This policy describes how Arthur DELPECH DE FRAYSSINET processes the personal data (“Personal Data”) collected from prospects, clients and partners (“Clients”):

  • when browsing the website https://governit.fr (the “Site”) and when using its features;
  • during telephone enquiries;
  • as part of the establishment of contractual relationships (contract signing, etc.) and the follow-up of those contractual relationships;
  • by any other means.

The reference texts for this policy are the General Data Protection Regulation (GDPR) No. 2016/679/EU of 27 April 2016 — applicable since 25 May 2018 — and the French Data Protection Act (“Informatique et Libertés”) of 6 January 1978 as amended.

This policy may be amended, supplemented or updated, in particular to reflect legal, regulatory, judicial or technical developments. However, Clients’ Personal Data will always be processed in accordance with the policy in force at the time of collection, unless a mandatory legal requirement provides otherwise and applies retroactively.

1. The Personal Data collected are as follows:

  • On the website https://governit.fr, via the contact forms: surname, first name, telephone number, email address, company, professional website, and any message submitted by the Client.
  • For commercial prospecting: surname, first name, postal address, email address and telephone number.
  • For the establishment and follow-up of contractual relationships: surname, first name, postal address, email address, telephone number, company and professional website.

Arthur DELPECH DE FRAYSSINET confirms that no “sensitive data”, within the meaning of Article 9(1) of the GDPR (for example, health data), are collected.

2. The main purposes for which the Personal Data are collected are as follows:

  • to enable Arthur DELPECH DE FRAYSSINET to respond to any requests for information from Clients regarding the services he provides;
  • to enable Clients to browse and use the features of the Site.
  • to enable Arthur DELPECH DE FRAYSSINET to send commercial information and marketing messages by email, SMS, telephone calls and postal mail.
  • to enable the signing of contracts and to ensure the follow-up of contractual relationships.

When certain information or statements are required to access specific features of the Site, this mandatory nature is indicated at the time the Personal Data are entered. If a Client refuses to provide the required information, access to certain services, features or sections of the Site may be denied.

3. Clients’ Personal Data are retained

Clients’ Personal Data are retained for a period not exceeding the duration of the commercial process, unless it results in the signing of a contract. In that case, the data are retained for a period not exceeding 5 or 10 years from the end of the contract, depending on the nature of the Personal Data, unless:

  • the Client exercises one of the rights granted to them under the applicable legislation, in accordance with the conditions set out below.
  • a longer retention period is authorised or required under a legal or regulatory provision.

4. Regarding security and confidentiality:

Regarding security and confidentiality, Arthur DELPECH DE FRAYSSINET implements organisational, technical and software measures to protect Personal Data against alteration, destruction and unauthorised access.

5. Access to your Personal Data is strictly limited

Access to your Personal Data is strictly limited to the employees and authorised agents of Arthur DELPECH DE FRAYSSINET, who are permitted to access it only as part of their duties and are bound by a confidentiality obligation.
However, the Personal Data collected may be disclosed to subcontractors contractually responsible for carrying out the tasks necessary for the proper functioning of the Site and its services, as well as for the proper management of the relationship with the Client, without the Client needing to give prior consent. It is specified that, in performing their services, subcontractors have only limited access to Clients’ Personal Data and are contractually required to use such data in compliance with the applicable personal data protection legislation.
Apart from the cases mentioned above, Arthur DELPECH DE FRAYSSINET undertakes not to sell, rent, transfer or grant access to Personal Data to third parties without the Clients’ prior consent, unless required to do so for a legitimate reason (legal obligation, fraud prevention, defence of legal rights, etc.).

6. Clients have the following rights:

Clients have the following rights under the applicable legal and regulatory provisions, in particular the GDPR and the French Data Protection Act:

  • a right of access to obtain information about the Personal Data concerning them;
  • a right to have such data rectified if it is inaccurate;
  • a right to data portability or to the erasure of their Personal Data;
  • a right to restrict the processing of their Personal Data;
  • a right to object to the processing of their Personal Data;
  • a right to withdraw consent to the use of their contact details for the sending of commercial information and marketing messages by email, SMS, telephone calls and postal mail.

For security reasons and to prevent any fraudulent request, the request must be accompanied by proof of identity. This document will be destroyed once the request has been processed.

7. Cookie Policy

A “cookie” is a text file placed on the Client’s device (computer, mobile, tablet) when visiting a website. It stores information relating to the Client’s browsing on the Site and enables its issuer to identify the device on which it is stored for the entire duration of the cookie’s validity.

Some cookies are essential for using a website, while others help optimise and personalise the displayed content.

Arthur DELPECH DE FRAYSSINET uses two types of cookies:
